Simple Battery

Penal Code § 242 is a misdemeanor in California. Simple battery is willful use of force against another. The force is defined as an harmful or offensive touching of another. It is not a battery if the touching was done in self-defense, defense of others or while reasonably disciplining a child. Injury is not required to be proven for simple battery. If convicted of this crime the person convicted can spend up to 6 months in county jail and pay a $2,000 fine.

Battery Against A Police Officer & Others

Simple battery can be aggravated if the person who is the named victim is listed in Penal Code § 243(b). This code lists several named victims occupations which include police officers, firefighters, custodial officers (police at the jails), lifeguards and so on. Nevertheless, if those persons are the named victim of a battery then the maximum jail time increased to 1 years in jail.

Battery Against A Custodial Officer & Others Causing Injury

Punishment for battery is further aggravated if those same persons listed in Penal Code § 243(c) are injured in any way. Then the crime becomes a “wobbler” and can be charged as a misdemeanor or a felony. If charged as a misdemeanor the maximum jail sentence that can be imposed is 1 year. If charged as a felony the sentencing triad is 16 months, 2 years or 3 years in custody and a fine up to $10,000 dollars. (see Penal Code § 243(c))

Battery Against Police Officer (No Injury Required)

Even when no injury occurs but the named victim is a peace officer performing his or her duties, then the crime becomes a “wobbler” and can be charged as a misdemeanor or a felony. If charged as a misdemeanor the maximum jail sentence that can be imposed is 1 year. If charged as a felony the sentencing triad is 16 months, 2, 3 years in custody and a fine up to $10,000 dollars. (see Penal Code § 243(c)(2))

Battery Causing Serious Bodily Injury

When Serious Bodily Injury is inflicted from a battery then the crime is not only aggravated, but it becomes a “Strike” for the purposes of California’s “Three Strikes Law”. This crime is aggravated under these circumstances and then becomes a “wobbler” and can be charged as a misdemeanor or a felony. If charged as a misdemeanor the maximum jail sentence that can be imposed is 1 year. If charged as a felony the sentencing triad is 2, 3 or 4 years in custody and a fine up to $10,000 dollars. (see Penal Code § 243(d))

Disturbing The Peace

Disturbing the peace under Penal Code § 415 has subdivisions which someone can be charged.

  1. Unlawful fighting or challenging to fight
  2. Unreasonable Noise
  3. Fighting Words.
