🧑⚖️ The Right to Legal Representation
One of your most important protections is the right to an attorney. In the landmark case Gideon v. Wainwright (1963), the U.S. Supreme Court ruled that the Sixth Amendment guarantees a right to counsel—even if you cannot afford to hire one.
In California, if you cannot retain private counsel, the court will appoint a public defender or a qualified court-appointed attorney. Public defenders are highly trained, experienced attorneys paid by the government to represent individuals at no personal cost. Many are skilled litigators who handle hundreds of cases each year, developing deep familiarity with local courts, prosecutors, and procedures.
⚖️ Attorney Tai C. Bogan began his career as a Public Defender in San Joaquin County. He never forgets his roots and continues to hold deep respect for public defenders across California. “We’re all on the same team when it comes to defending the Constitution and standing up for the accused,” says Mr. Bogan. “A strong public defender’s office is essential to a strong defense bar.”
At The Bogan Law Firm, we provide personalized, strategic representation with direct access to a Certified Criminal Law Specialist. For clients facing serious charges, complex case facts, or professional licensing consequences, we offer the time and focus needed to prepare the strongest possible defense.
⚖️ Your Rights in Adult Criminal Court
If you’re charged with a misdemeanor or felony in California, you are entitled to:
- Representation by an Attorney at all stages of the case
- A Speedy and Public Trial to avoid unreasonable delay
- A Preliminary Hearing (for felonies, unless by grand jury indictment)
- Trial by Jury or Judge depending on your preference
- The Right to Remain Silent and avoid self-incrimination
- The Right to Testify if you choose to
- The Right to Confront Witnesses who testify against you
- Subpoena Power to compel witness testimony or evidence on your behalf
- The Right to Present a Defense, including introducing evidence, lay and expert testimony
- Protection Against Unlawful Search and Seizure under the Fourth Amendment
These rights apply whether you are accused of a simple misdemeanor or a serious felony. How and when you assert them can greatly affect the outcome of your case.
👨💼 Your Rights in Juvenile Court
Minors facing delinquency proceedings have a similar but distinct set of rights, including:
- The Right to an Attorney
- The Right to Remain Silent
- The Right to Testify
- The Right to Present Evidence and Call Witnesses
- The Right to a Timely Jurisdictional Hearing
- The Right to Subpoena Witnesses
Unlike adult court, juvenile court proceedings are handled by a judge rather than a jury. While the system is designed to be rehabilitative, sustained findings can still carry serious long-term consequences.
🚨 If your child is facing charges, don’t wait. A juvenile record can affect college admissions, employment, and more.

Your constitutional rights are only effective if you know when and how to use them. At The Bogan Law Firm, we fight to ensure those rights are upheld and respected—whether we’re challenging an illegal stop, disputing a confession, or suppressing unlawful evidence.
